By using our site, you indicate that you accept these terms and conditions and that you agree to abide by them.  If you do not agree to these terms, please refrain from using the Website or purchasing resources from it.

Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice. We will not be liable if for any reason our site is unavailable at any time or for any period.

All personal information you provide to us  will be treated in accordance with the Data Protection Act 1998.

Your details are provided to us for the purposes of registering with the Website or the purchase of the various goods or resources available on the Website and will not be used for any other purpose unless specifically 'opted in' by you or as required by law.

We reserve the right to make alterations and corrections to the information contained in the Website at any time without notice (including to prices of products, which should be treated as an invitation to treat).

In no event shall Five Areas Ltd be liable for special, indirect or consequential loss or damage arising out of or in connection with the use, copying or display of the contents of this Website.

We accept no responsibility for and exclude all liability for damage and loss in connection with browsing this site, use of information on this site and downloading any material from it including but not limited to errors, inaccuracies and omissions. Where you purchase products from the Website our total liability to you in connection with any breach by us of these Terms and Conditions shall not exceed the sums received from you in relation to such purchase.

All advice, information and opinions contained in the various resources written by Dr Chris Williams are based on his own views, research and analysis as a qualified psychiatrist and recognised teacher and researcher in the area of cognitive behaviour therapy self-help. While care has been taken to check the accuracy of the content and believe that many users will find it beneficial, no assurance or warranty is given regarding the accuracy of the content or applicability in relation to particular circumstances. Complaints & Notices
We aim to provide a high level of customer service. If any part of these terms and conditions is found to be unenforceable as a matter of law, the enforceability of any other part of these terms and conditions will not be affected.

Language, Governing Law and Jurisdiction
These terms and conditions are governed by the law of Scotland and the Scottish courts shall have exclusive jurisdiction over these terms and conditions.

Additional terms and conditions where purchasing from the Website

How your contract with us is formed
When you submit your online order form, you are offering to buy products at the price set out in the order. Our policy is to automatically cancel orders if we have not received payment within 14 days. You will be informed of this cancellation by email. Resources are only dispatched when any payment is received.

Confirming the Order 
In placing this order you confirm that you are old enough to purchase the resources. 
Acceptance of your order and the creation of a legally binding agreement between us will occur when we send you a confirmation e mail setting out details of your order unless:
a) we have notified you that we do not accept your order or you cancel your order due to stock unavailability or non-payment (Please see the “Pricing, Delivery Charges and Availability” section below); or
b) you subsequently return the item dispatched to you pursuant to the “Refunds, Returns and Exchange” section below.

If, before you have submitted your order on the Website, you discover you have made a mistake with your order, you can revisit your order and correct the mistakes before confirming and submitting your order to us. It is your responsibility to ensure that your order is correct before submitting it to us. If you have any problems with your order, please contact orders'fiveareas.com.

Please do this before we confirm our acceptance of your order. We are unable to rectify mistakes after this time, although you still have the right to cancel as described in the “Refunds, Returns & Exchanges” section below.

You do not own the resources until we receive payment in full. You will become the owner of the products you have ordered when the products have been delivered to you. Completion of the contract between you and us will take place on dispatch to you of the products ordered. This will be deemed to be our acceptance of your offer and to have been effectively communicated to you.

Payment Options
Orders can be placed online using a credit/debit card. Alternatively you can send a cheque or postal order made payable to “Five Areas”. When paying for items by cheque delivery may be slowed by up to 6 days due to the time taken to process cheques.

Before placing an order you must be aged 18 years or over.

Payment Details 
We accept payment through PayPal by credit or debit card or cheque. All product prices and delivery charges are shown in UK pounds sterling. Your payment card company will perform any currency conversion.

For larger orders from organisations an invoice can be raised.

Pricing, Delivery Charges and Availability
The current prices on the Website are checked regularly. However, if we find the price has changed when we receive your order we will contact you and ask if you wish to proceed. In addition, if the products that you have ordered are no longer available, we may:
a) decline your order;
b) inform you when the product becomes available; or
c) offer you substituted products of a similar nature and quality.

If (b) or (c) apply, we will contact you by e-mail, letter or telephone through the contact details provided on your order form and ask if you wish to proceed. In both cases, if you confirm that you wish to proceed, acceptance of your order will take place when we send you a confirmation e mail setting out details of your order.

Overseas delivery: Orders can be placed online for delivery to UK addresses. Special arrangements can be made for overseas delivery. Please email orders@fiveareas.com for a shipping quote and alternatively view the overseas orders section of the site. Please note: certain products such as DVDs are UK-developed to work on UK television equipment such as DVD players and television sets. No refunds will be made for non-UK purchases of DVD's where the problem is caused by incompatibility of the DVD with the TV/DVD equipment.

If you order products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination.  You will be responsible for payment of any such import duties and taxes.  Please note that we have no control over these charges and cannot predict their amount.  Please contact your local customs office for further information before placing your order.

Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined.  We will not be liable for any breach by you of any such laws.

Price Increases 
Five Areas reserves the right to change prices listed without notice. All orders for products are subject to availability and Five Areas reserves the right to refuse to supply to any individual or company.

Pricing Errors 
We reserve the right to cancel any order where obvious errors in pricing or product description have occurred. Although we make every effort to ensure the prices on the Website are correct, mistakes may sometimes be made. If we discover a mistake in the price of the products you have ordered, we will tell you and give you the option of either reconfirming your order at the correct price or cancelling your order. If we are unable to contact you or we receive no reply from you, we will cancel your order. If your order is cancelled and you have already paid for the products you will receive a full refund.

Discounts shown are against RRP or previous selling price.

Postage and packing
We understand how important it is to show our postage charges up front, rather than add them in at checkout as "hidden" charges. They are therefore included in all costs and refer to UK delivery only.

Dispatch and delivery
Completion of the contract between you and us will take place on dispatch to you of the products ordered. Once the products have been dispatched, we will notify you by e mail. Resources are usually posted out by second class post. Please note that we do not post out items on Saturday, Sunday or Bank holidays.

If part of an order is out of stock, on occasion part-orders will be dispatched with a later delivery of out of stock items at no cost to you. If any resource cannot be delivered to you within 30 days of the date of your original order, we will contact you giving you details of the likely delivery date. If you would rather not wait, you will have the right to cancel your order at that time [within 7 days of notification by us to you of the likely delivery date].

Product Returns, Refunds, Shortages & Exchanges

If you are contracting as a consumer, you may cancel an order at any time within seven (7) working days, beginning on the day after you received the products.  In this case, you will receive a full refund of the price paid for the Products in accordance with our refunds policy and the Consumer Protection (Distance Selling) Regulations 2000.

To cancel and order, you must inform us in writing at our address above or by emailing admin@fiveareas.com.  You must also return the product(s) to us immediately, in the same condition which you received them, at your own cost and risk.  You have an obligation to take reasonable care of the products while they are in your possession.

You have no right to cancel your order in accordance with this condition if the products you have ordered are: downloaded resources, or audio; video or DVD recordings where the holographic seal and/or shrink-wrap has been unsealed by you. 

Damaged goods: In the unlikely event that you receive goods that have been damaged in transit please contact orders@fiveareas.com within 24hrs of delivery of the goods.

Shortages: Any shortage must be notified to orders@fiveareas.com within seven days of receipt of the goods otherwise no claim can be made.
DVD's - Please note: Our DVDs are Region 2 encoded and no refunds will be made for non-UK purchases of DVD's where the problem is caused by failure of the DVD to play on incompatible equipment.

Products may be returned by post in accordance with the following procedure:- 
- Repackage the products securely and send the products together with the reason for return, the invoice number, your e-mail address or telephone number and instructions as to whether you would like a refund or a replacement. You will find the Returns address on the paperwork that arrives with your order. 
- All unwanted goods must be in resalable condition, in their original packaging and with any security seals still intact. 
- Returns by post are made at your risk. We recommend that you use an insured registered mail service as returns not received by us cannot be credited to you.

Refunds will be credited to your payment card. Refunds will not be paid in cash.

Goods 'Lost in Transit' 
For deliveries to any UK address please allow 10 working days from the date of dispatch. If this time elapses and the goods have not arrived, you should contact your local post office to verify that no items are being held for you pending delivery. If your post office has confirmed that no packages are being held, please contact us at orders@fiveareas.com .

If you wish replacement goods to be sent, you must contact us within 28 days of your order being dispatched. 
We will not send replacement items unless you have checked your local post office first. 

Please note: We cannot accept responsibility for lost or misdirected returns and recommend for your own protection that you obtain an appropriate level of postal insurance when returning items to us.
This returns policy is provided in addition to your statutory rights, which remains unaffected.

Seller Liability 
We do not accept liability for shortages in quantities delivered unless you notify us of any claim of short delivery of the goods within seven working days of delivery. In such circumstances our liability shall be restricted to making good the shortfall.

Trade Description
Every care has been taken to ensure that the description and specifications are correct at the time of going to press. Please inform us of any inaccuracies and we will correct the information on the site.

Other information of which you need to be aware:
We advise you to print a copy of your order and of these terms and conditions for your information in the future.

You are entitled to cancel any payment made or due to be made in respect of an order in the event that you discover that your card has been used fraudulently by an unauthorized person to buy your products from our Website. Your card issuer will be liable to re-credit your credit or debit card in respect of such fraudulent payments. If you discover that fraudulent use has been made of your card, you should immediately notify us and your card issuer and provide full details.

We reserve the right not to sell to trade customers for re-sale purposes

The security of information and payments transmitted via the Internet cannot be guaranteed. Any losses incurred or sustained by users who transmit information by means of e-mail or other internet link shall be borne solely and exclusively by such user and in no event shall any such losses in whole or part by borne by Five Areas.

All brand names, product names and titles used in this site are trademarks or trade names of their respective holders. No permission is given in respect of use of any of the above, and such use may constitute an infringement of the holders' rights.

Statutory Rights
